Feature Highlight: Filing An Emergency Bankruptcy

Assembling all of the documents and information for a bankruptcy case can sometimes be a game of cat and mouse between the attorney and client but if a client is facing a wage garnishment or house foreclosure, the bankruptcy must be filed quickly to get the case started and stop the action. This process is referred to as an emergency bankruptcy (or skeleton) filing. Once the minimum documents are filed with the bankruptcy court, an automatic stay will kick in, prohibiting the creditor from pursuing collections on the debtor. 

 

NextChapter allows you to easily file an Emergency Bankruptcy with the click of a button. In the Review & File section, you'll see an option to select Emergency Filing at the bottom of the second column titled "Petition PDF Packet". When you select Emergency Filing, the following documents will automatically be added to the Petition PDF Packet column:

 

- Voluntary Petition

- Creditor Matrix
- Verification of Creditor Matrix
- Notice for Individuals Filing for Bankruptcy
- Attorney's Disclosure of Compensation


You can add or remove any of the documents by dragging and dropping the documents. All documents included in the second column titled "Petition PDF Packet" will be filed to the court. 

 

 

*Note: When you are ready to file the remaining documents, you can select which documents you would like to generate from the Download & Print section. The additional forms will need to be saved and uploaded to the case from the court's site. At this time, NextChapter only supports filing the initial case and does not allow users to upload additional documents after the case is created. This option will be coming in our Fall '17 Release.
