Updates to the Discharge Process for Student Loan Borrowers

The Department of Justice with the help of the Department of Education outlined updates to the process to request to discharge student loan debt through bankruptcy in an attempt to create a fairer and more accessible process. Through an outlined three-phase review which begins with the completion of an attestation form, borrowers and their attorneys should be able to have a clearer idea of when discharge is appropriate. NextChapter is working with counsel and its development teams to implement this new form into the bankruptcy workflow so that attorneys can easily use the information from Schedule I and the Means Test to complete the information necessary to assist with the discharge request.

Rose Bardouille is an experienced Litigation and Bankruptcy paralegal who works at Dwyer & Knight, which was founded in 2001. Their firm is comprised of nine staff members and is based on the East Coast in Flagler Beach, Florida. Their firm files approximately 50 bankruptcy cases a year and specializes in other areas outside of Bankruptcy such as Personal Injury, Family Law, Criminal Defense and Estate Planning.

Rose began her career as a Litigation paralegal, but as Dwyer & Knight began practicing Bankruptcy, she realized how much the firm helped families in need. This ultimately began her journey with Bankruptcy and inspired her to move into that area of law. Rose still practices Litigation, but mainly focuses on Bankruptcy since it is a large part of what their firm does. She first began using NextChapter in 2021 and has found that it is “very user-friendly and has great features that many other bankruptcy case management systems are lacking.” Along with that, Rose really enjoys the DebtorCC Credit Counseling Integration because it makes her workflow more efficient.

Outside of work you can catch Rose out for a jog, enjoying the outdoors, or spending time with her children and husband. She is also the Family Life Director at her church and teaches the Youth Class at church where she enjoys getting to influence young individuals in a positive way. We are proud to have such a unique and kind paralegal using our software!

Meet the Team 👋

It’s almost 2023 and we are excited to go into the new year with our new team member Clodagh Tinney! Clodagh has been brought on full-time as NextChapter’s Product Designer after working as our contractor since May. 

Clodagh currently resides in Santa Monica, which is the sixth U.S. state she’s lived in! After living in so many places,  she doesn't consider herself to be “from” anywhere. At NextChapter, she is most excited to be back on the same team as Mandy Ballinger. They were former colleagues in 2014 and she even bought a Samsung tablet from her.

Clodagh’s best productivity hack is, “[using an] app called Due that I prefer to the Reminders app for iPhone. I use it for basically everything.”

Outside of work, Clodagh is looking for new hobbies - starting a new gym, piano lessons, yoga, and hopefully adopting a dog. You can also find her in the snack aisle at Trader Joe’s.
